Supreme Court Asked To Exempt Churches From Employee Discrimination Lawsuits

WASHINGTON -- The Supreme Court dipped its toes in holy waters Wednesday morning, but only a minority of the justices appeared ready to fully immerse the federal government in determining when an employee can sue religious organizations for civil rights violations.

In the case of Hosanna-Tabor Evangelical Lutheran Church and School v. Equal Employment Opportunity Commission, the Court is considering for the first time the scope of the "ministerial exception" -- a doctrine developed by the lower courts over the past 40 years. Under the ministerial exception, the federal courts decline to hear certain discrimination lawsuits brought by employees of religious organizations. The exception is meant to preserve the First Amendment wall between church and state.

In 2000, Hosanna-Tabor, a Lutheran grade school in Michigan, made Cheryl Perich a "commissioned minister" so that she could be promoted from a year-to-year contract employee to a "called" teacher deemed religiously fit for a permanent position at the school. As a called teacher, Perich taught a variety of secular subjects as well as a religion class. In 2004, she went on disability leave for what was soon diagnosed as narcolepsy. Per its policy, the school asked her to resign once her absence exceeded six months, but she refused. Rather than submit to the school's request that her complaint be handled within the Lutheran church's own adjudicative process, Perich threatened to file suit with the EEOC under the Americans with Disabilities Act. In response, the Hosanna-Tabor congregation rescinded Perich's "call," which drove her to follow through on her threat to file with the EEOC.

On Wednesday morning, Douglas Laycock, a law professor at the University of Virginia who represented Hosanna-Tabor before the Supreme Court, began by proclaiming that "the churches do not set the criteria for selecting or removing the officers of government, and government does not set the criteria for selecting and removing officers of the church."

Justice Sonia Sotomayor didn't buy Laycock's aphorism. "We know from the news recently that there was a church whose religious beliefs centered around sexually exploiting women and, I believe, children. Regardless of whether it's a religious belief or not, doesn't society have a right at some point to say certain conduct is unacceptable," asked Sotomayor. "And once we say that's unacceptable, can and why shouldn't we protect the people who are doing what the law requires [by] reporting it?"

Turning from hypotheticals to the facts of the case, Justice Anthony Kennedy, who is known for his robust view of the courts' role, expressed astonishment that Perich "was fired for simply asking for a hearing." And Laycock's response -- that Perich could get a hearing from the church for her claims against the church -- hardly heartened Kennedy. "You're asking for an exemption so that these issues can't even be tried," said the justice.

Despite these challenges to Laycock's argument, Hosanna-Tabor did not have a bad day in the high court.

The specific question in Perich's case is whether an exception originally focused on relations between religious organizations and their clergy and similar workers also applies to employees with major secular responsibilities. If federal courts weighed issues of employment discrimination or retaliation such as Perich's, judges would have to figure out who qualifies as a minister, and whether the religious organization's action was based on its religion's tenets or was motivated by some prohibited reason such as the employee's gender or disability.

Throughout the hour of oral argument, Justices Samuel Alito and Stephen Breyer led their colleagues in suggesting that the courts would face a fiery baptism if they tried to wade into such competing claims of religious autonomy and individual rights.

According to Alito, to determine whether Hosanna-Tabor's internal conflict resolution process was a central tenet of Lutheranism entitled to a court's deference, a judge would have to ask, "What did Martin Luther actually say about suing the church?" As opposed to last year's violent video games case, when he mocked originalism by saying, "What Justice Scalia wants to know is what James Madison thought about violent video games," this morning Alito was quite serious.

Indeed, the prospect of a judge deciding for a church which of its tenets was worth respecting daunted not only Alito, but also Chief Justice John Roberts and Justices Antonin Scalia and Elena Kagan. The latter two regarded the idea as "extraordinary" and "amazing," respectively.

Questioning Assistant Solicitor General Leondra Kruger, who argued for the EEOC, Justice Breyer tried in vain to find a way for Perich and others like her to have their day in court, but just couldn't "see how you avoid getting into religion to some degree."

"This is tough, and I'm stuck," Breyer said.

Tempted by wrongs that in other instances call out for a judicial remedy, Breyer's abnegation before the First Amendment's protection of religious freedom was something almost priestly.

The paradigmatic ministerial exception for the Roman Catholic Church against sexual discrimination lawsuits brought by would-be female priests loomed large during oral argument. Scalia, Breyer, Alito and Roberts all took turns pressing Kruger and Perich's lawyer, former Acting Solicitor General Walter Dellinger, on why a Lutheran tenet commanding internal dispute resolution did not deserve the same respect as Catholicism's male-only priesthood. The lawyers could not answer to the justices' satisfaction.

During Laycock's argument, Justice Ruth Bader Ginsburg did have a hard time finding consistency in Hosanna-Tabor's policy on employee complaints. In his written briefs, Laycock had said that an employee could bring some suits, such as a complaint about unsafe working conditions, against Hosanna-Tabor without running into the ministerial exception. "I don't follow why" such a claim "would not fall under the same ban on keeping disputes in-house?" said Ginsburg.

According to Court-watchers, Ginsburg's stated concern about inconsistency could be extended to those of her colleagues who on Wednesday held fast to the high wall between church and state, but who rarely find a cross, cr?che, Ten Commandments plaque or prayer inappropriate for display in state institutions.

A decision in Hosanna-Tabor v. EEOC is expected by the end of the term in June.

New Delhi-- Bristol-Myers Squibb Company (NYSE: BMY) and AstraZeneca (NYSE: AZN) announced results from an investigational Phase 3b clinical study in which the addition of ONGLYZA? (saxagliptin) 5 mg to ongoing insulin therapy (with or without metformin) maintained reductions of blood sugar levels (glycosylated hemoglobin levels, or HbA1c) in adult patients with type 2 diabetes compared to the addition of placebo (with or without metformin) from 24 to 52 weeks. These results, presented at the 47th European Association for the Study of Diabetes (EASD) Annual Meeting in Lisbon, Portugal, are from an extension of a 24-week trial, the results of which were presented at the 71st American Diabetes Association (ADA) Scientific Sessions in San Diego, CA in June 2011.

In the 52-week analysis, change from baseline in HbA1c in patients taking ONGLYZA 5 mg added to insulin (with or without metformin) was -0.75% compared to -0.38% for those taking placebo added to insulin (with or without metformin). There was also a greater increase from baseline mean daily insulin dose in patients who received placebo compared to patients who received ONGLYZA 5 mg (with or without metformin). It is unknown whether increased insulin doses by patients in the placebo group could have affected the magnitude of differences seen between the two treatment groups in the efficacy analyses.The proportion of patients in each treatment group who experienced at least one adverse event over the 52-week treatment period was similar. The most common events included hypoglycemia, urinary tract infection, nasopharyngitis, upper respiratory tract infection, headache and bronchitis.

"Since many patients with type 2 diabetes will eventually require insulin, it is important to assess a compound's ability to be used in combination with insulin to manage blood glucose control over the long term," said Anthony Barnett, MD, University of Birmingham and Heart of England NHS Foundation Trust and principal investigator of the study. "This is the first longer- term study to report that ONGLYZA 5 mg, used with insulin, maintains improvement in glucose control over 24 to 52 weeks in adult patients with type 2 diabetes."

In Europe, ONGLYZA is indicated as a once-daily 5 mg oral tablet dose in adult patients with type 2 diabetes mellitus to improve glycemic control:

?in combination with metformin, when metformin alone, with diet and exercise, does not provide adequate glycemic control;

?in combination with a sulphonylurea, when sulphonylurea alone, with diet and exercise, does not provide adequate glycemic control in patients for whom use of metformin is considered inappropriate; or

?in combination with a thiazolidinedione, when the thiazolidinedione alone, with diet and exercise, does not provide adequate glycemic control in patients for whom use of a thiazolidinedione is considered appropriate.

ONGLYZA is currently not indicated in combination with insulin therapy.

ONGLYZA should not be used for the treatment of patients with type 1 diabetes mellitus or diabetic ketoacidosis (increased levels of ketones in the blood or urine), as it would not be effective in these settings.

About the Study

This was a Phase 3b, multi-center, randomized, placebo-controlled, double-blind 24- week study with a 28-week extension. The primary endpoint at 24 weeks was mean change in HbA1c from baseline of ONGLYZA 5 mg added to insulin (with or without metformin) compared to placebo added to insulin (with or without metformin). The study met the primary endpoint, demonstrating that ONGLYZA 5 mg added to insulin (with or without metformin) achieved a statistically significant HbA1c reduction from baseline of -0.75% compared to -0.38% (p-value

The study included 455 individuals with type 2 diabetes (ages 18 - 78) with inadequate glycemic control (HbA1c levels ? 7.5% and ? 11%; mean baseline HbA1c = 8.7%) who were receiving a stable dose of insulin (with or without metformin). Patients were randomly assigned to receive ONGLYZA 5 mg added to insulin (n = 304) or placebo added to insulin (n = 151) once-daily for 52 weeks. During the initial 24-week period, patients were advised to maintain stable insulin doses, which could be decreased to reduce the risk of hypoglycemia. Patients with hyperglycemia or with substantially increased insulin had a rescue visit and remained in the study on a flexible insulin regimen. During the extension period, all patients were able to adopt a flexible insulin regimen. Sixty-nine percent of patients were treated with metformin, and the dose could not be changed in the study.

Of the 455 patients initially randomized and treated in the study, 371 patients completed the extension (81% of patients in the ONGLYZA added to insulin group and 83% of patients in the placebo added to insulin group, of those originally treated).

Study Results

Over 52 weeks, patients receiving ONGLYZA 5 mg added to insulin (with or without metformin) compared to patients receiving placebo added to insulin (with or without metformin) showed the following:

-Increases in mean change in body weight from baseline of 0.8 kg for ONGLYZA 5 mg vs. 0.5 kg for placebo (95% CI: -0.3, 0.9; n = 246, baseline 87.7 kg for ONGLYZA 5 mg added to insulin; n = 125, baseline 86.2 kg for placebo added to insulin)

Most patients completed the study through week 52 (81% and 83% of patients in the ONGLYZA and placebo groups, respectively).

Over the 52-week treatment period, 66.4% of patients in the ONGLYZA 5 mg added to insulin group had at least one adverse event compared to 71.5% in the placebo added to insulin group. Hypoglycemia was reported in 22.7% of patients in the ONGLYZA 5 mg added to insulin group compared to 26.5% in the placebo added to insulin group, with confirmed hypoglycemia of 7.6% and 6.6%, respectively. Confirmed hypoglycemia was defined as hypoglycemic symptoms associated with a fingerstick glucose measurement of ? 50 mg/dL at the time of the event.

The other most common adverse events (incidence ? 5% for ONGLYZA 5 mg) were as follows for ONGLYZA 5 mg added to insulin (with or without metformin) compared to placebo added to insulin (with or without metformin) respectively:

- Urinary tract infections (7.9% vs. 7.9%)

- Nasopharyngitis (6.3% vs. 6.6%)

- Upper respiratory tract infections (6.3% vs. 7.3%)

- Headache (5.9% vs. 4.0%)

- Bronchitis (5.3% vs.3.3%)

Twenty-five (8.2%) patients in the ONGLYZA 5 mg added to insulin group reported at least one serious adverse event (SAE), as compared to 13 (8.6%) patients in the placebo added to insulin group. Treatment-related SAEs were reported in three patients in the ONGLYZA 5 mg added to insulin group vs. zero in the placebo added to insulin group. In the ONGLYZA 5 mg added to insulin group, nine (3.0%) patients discontinued the study due to adverse events, of which four were considered serious adverse events. In the placebo added to insulin group, three (2.0%) patients discontinued due to adverse events, of which zero were considered serious adverse events. There were also two deaths in the ONGLYZA added to insulin group, in which both events were considered unrelated to treatment.

About ONGLYZA? (saxagliptin)

As of September 2011, ONGLYZA has been submitted for regulatory review in more than 90 countries and is approved in 66 countries, including the U.S., Canada, Mexico, 30 European countries, India, Brazil and China.

Warnings and Precautions

-Use with Medications Known to Cause Hypoglycemia: Insulin secretagogues, such as sulfonylureas, cause hypoglycemia. Therefore, a lower dose of the insulin secretagogue may be required to reduce the risk of hypoglycemia when used in combination with ONGLYZA.

-Macrovascular Outcomes: There have been no clinical studies establishing conclusive evidence of macrovascular risk reduction with ONGLYZA or any other antidiabetic drug.

Most Common Adverse Reactions

-Most common adverse reactions (regardless of investigator assessment of causality) reported in ? 5% of patients treated with ONGLYZA and more commonly than in patients treated with control were upper respiratory tract infection (7.7%, 7.6%), headache (7.5%, 5.2%), nasopharyngitis (6.9%, 4.0%) and urinary tract infection (6.8%, 6.1%).

-When used as add-on combination therapy with a thiazolidinedione, the incidence of peripheral edema for ONGLYZA 2.5 mg, 5 mg, and placebo was 3.1%, 8.1% and 4.3%, respectively.

Drug Interactions

Because ketoconazole, a strong CYP3A4/5 inhibitor, increased saxagliptin exposure, the dose of ONGLYZA should be limited to 2.5 mg when coadministered with a strong CYP3A4/5 inhibitor (e.g., atazanavir, clarithromycin, indinavir, itraconazole, ketoconazole, nefazodone, nelfinavir, ritonavir, saquinavir and telithromycin).

Use in Specific Populations

-Patients with Renal Impairment: The dose of ONGLYZA (saxagliptin) is 2.5 mg once daily for patients with moderate or severe renal impairment, or with end-stage renal disease requiring hemodialysis (creatinine clearance [CrCl] ? 50 mL/min). ONGLYZA should be administered following hemodialysis. ONGLYZA has not been studied in patients undergoing peritoneal dialysis. Assessment of renal function is recommended prior to initiation of ONGLYZA and periodically thereafter.

-Pregnant and Nursing Women: There are no adequate and well-controlled studies in pregnant women. ONGLYZA, like other antidiabetic medications, should be used during pregnancy only if clearly needed. It is not known whether saxagliptin is secreted in human milk. Because many drugs are secreted in human milk, caution should be exercised when ONGLYZA is administered to a nursing woman.

-Pediatric Patients: Safety and effectiveness of ONGLYZA in pediatric patients have not been established.

(AP) ? House Speaker John Boehner on Tuesday dismissed a Senate bill that could punish China for undervaluing its currency, saying it was "pretty dangerous" for Congress to tell another country how to run its monetary policy.

Boehner's statement to reporters came a day after the Senate voted 79-19 to advance legislation making it easier to impose trade penalties against China for manipulating its currency to make Chinese goods cheaper and American exports more expensive.

Lawmakers have tried for the past six years to impose unilateral penalties on Beijing, and after Monday's vote, supporters said they had the momentum to get a bill through Congress this year.

"Here in the Senate we have heard the message loud and clear," Senate Majority Leader Harry Reid, D-Nev., said Tuesday. "We can't ignore blatant, unfair trade practices that put American workers at a disadvantage."

Sen. Charles Schumer, D-N.Y., a chief sponsor of the bill, came to the Senate floor to respond to Boehner: "The only thing that would be dangerous would be to continue turning the other cheek while China continues its assault on US jobs," he said.

Most economists say the Chinese currency is undervalued by about 30 percent, with some estimates of up to 40 percent, giving Chinese exports a significant advantage against American competitors.

Schumer pointed to comments made on Capitol Hill Tuesday by Fed Chairman Ben Bernanke expressing concern that "the Chinese currency policy is blocking what might be a more normal recovery process in the global economy."

Boehner, R-Ohio, said he understood the concerns, but was not sure that congressional action was the way to address the issue.

His position was not far from that of the Obama administration, which has said it is reviewing the Senate bill.

In general, the administration has said it is pressuring China to alter its exchange rate to better reflect market values but has cautioned against taking unilateral action. Many economists say China, the largest holder of U.S. debt, would respond with retaliatory measures against U.S. producers.

Sen. Bob Corker, R-Tenn., also warned that unilateral action could backfire. "What we're really doing is pursuing the wrong issues in the name of trying to make ourselves look good back home."

But House Democrats accused Boehner of siding with the multinational companies that largely oppose the Senate bill and against the small businesses that are looking for relief from unfair Chinese competition.

Democrats cited estimates that forcing China to realign its currency could support 1.6 million American jobs.

"The House Republican leadership should not stand in the way of jobs and the American people," said Rep. Sander Levin of Michigan, the top Democrat on the House Ways and Means Committee.

"This is a lot of jobs we are talking about," said Rep. Bill Pascrell, D-N.J. "I hope the Republicans will rethink their knee-jerk reaction."

They noted that a year ago the House passed a more narrowly drawn measure on a 348-79 vote and that a majority of Republicans supported it. They said a bill introduced by Rep. Tim Ryan, D-Ohio, has 225 co-sponsors, more than half the House, with 61 Republicans signed on.

Republicans "know that if it comes up for a vote that it will pass," Levin said.

State leaders today announced the addition of surfing as a sport in Hawaii?s public schools.? The sport will allow for school sanctioned surf competitions as early as the spring of 2013.

The announcement was made today by Governor Neil Abercrombie, Hawai?i School Superintendent Kathryn Matayoshi, Board of Education member Keith Amemiya and 2011 Womens? World Surf Champion Carissa Moore.

?Hawaii is the birthplace of surfing,? said Gov. Abercrombie.? ?From Duke Kahanamoku to the thousands of residents and visitors who surf both recreationally and competitively, the sport is rooted in our culture and way of life,? he said.

?Bringing surfing to our students is another step in our collective goal to transform public education and provide our children with rich and diverse educational opportunities,? said Gov. Abercrombie.

Hawaii?s Carissa Moore, who became the youngest surfer ever to win a professional surfing world title this summer at the age of 18, joined in celebrating today?s announcement.

?It will open doors for a lot of students,? she said, explaining that surfing taught her important life skills such as perseverance, time management, and organization.

The Hawaii State Board of Education approved surfing as a high school sport in May 2004, but a variety of challenges were encountered?including lack of funding, which kept it from becoming a full-fledged school sport in the state.

The DOE intends to support the sport with outside funding sources, according to a statement released today by the department.

?Surfing will be an exciting addition for our students as we continue to expand and improve educational programs to increase student achievement,? said Superintendent Kathryn Matayoshi.

?School sports teach critical life lessons such as team work and goal-setting while helping students stay active and healthy,? she said.

BOE member Keith Amemiya, a former executive director of the Hawaii High School Athletic Association, said surfing will allow students to not only learn about their environment, but also about themselves.

?Surfing is a unique sport that often attracts athletes that may not necessarily be interested in more traditional sports such as football, basketball, baseball, and soccer,? he said.? ?Therefore, we?re confident that surfing will increase athletics participation numbers.? In our view, the more students that engage in athletics and other after school activities, the higher our student achievement rates will become,? said Amemiya.

The BOE and DOE will continue to discuss a plan to implement surfing as a high school sport during the Board?s General Business Meeting tomorrow, Oct. 4, in Honolulu.

Germany: 4 arrested ahead of unity festivities (AP)

BERLIN ? Four suspected Islamic extremists were arrested on suspicion of obtaining guns ahead of events marking the anniversary of German reunification but officials said Sunday they found no weapons or evidence of plans for an attack.

Three of the men were arrested Saturday in the Bonn area, Cologne police spokesman Carsten Moellers said. The fourth was arrested in Offenbach, near Frankfurt, and later released.

Moellers said that the men, aged between 22 and 27, were arrested because "we couldn't rule out that a crime was to be prepared"; and in view of the fact that celebrations marking the the 21st anniversary of reunification are being held in Bonn Monday.

Police said Sunday that they found no firearms or other dangerous objects during searches the men's apartments and that they ruled out the men, who they described as belonging to the "Islamist spectrum," posing any danger to the events in Bonn.

Germany's federal prosecutor's office also said there was no sign that the men belonged to any terrorist group and no indication of concrete plans for any attack.

The agency, which is responsible for terrorism cases, said it did not see grounds for it to take over the investigation.
