Police Fatally Shoot Marine In Palm Springs, Calif.

PALM SPRINGS, Calif. -- Police fatally shot a Camp Pendleton Marine who struck an officer with a car in a parking garage in Palm Springs, authorities said Monday.

The Marine repeatedly ignored orders to stop after being approached by officers on bike patrol around 2 a.m. Saturday, the Palm Springs Police Department said in a statement.

One of the officers partially climbed into the passenger window to stop the car, but the Marine accelerated, striking the other officer, the department said. The Marine kept driving with the officer hanging out of the window until the car crashed near the garage exit, it said.

Both officers were treated for injuries at a hospital and released. They have been placed on administrative leave while the department investigates.

The Marine died at the scene and the lone passenger, another Marine, was not injured, authorities said.

"In the course of these events, fearing for their safety and the safety of others both officers discharged their weapons," the statement said.

Police said authorities later found a smartphone in the car that was reported stolen by someone whose identification card was found in the Marine's pants pocket.

The lone passenger was arrested for investigation of public intoxication and for an unrelated misdemeanor warrant then released. Police did not release his name.

DeVillena's father, Alan DeVillena, told the newspaper his son and the passenger had gone out to celebrate the 237th birthday of the Marine Corps, which was Saturday.

The father said the family was headed to Palm Springs to find out what had happened after being notified of his son's death by the Marine Corps.

The newspaper reported both Marines were with the 1st Marine Logistics Group based in Camp Pendleton, but the men were stationed at Twentynine Palms.

Marine Corps officials could not be immediately reached for comment Monday when many offices were closed to celebrate Veterans Day.

DeVillena said his son served in Afghanistan and was due to finish his four-year enlistment in about two months. He said he planned to attend college.

"He was looking to get into audio engineering," DeVillena told the newspaper. "He wanted to get into recording. He wrote a lot. He had a passion for music."

Mum's internet drugs warning after death of son Richard Oates

THE mother of a recreational drug user has warned of the dangers of taking drugs bought on the internet.

Richard Oates took drugs he ordered online and died aged 28 from drug misuse.

His mother, Julie Wood, 55, says she cannot understand how the drugs packages were not intercepted by the authorities before being delivered to Richard's home.

She has also warned other parents to look for signs of drug use.

"Something needs to be done, Richard isn't a one-off case," she said.

"It was a stupid waste of a life, but it has to be a lesson learned.

"I can't understand how he was able to use internet forums and order drugs from all over the world without someone stopping them.

"I don't know how this was allowed."

Mr Oates was discovered dead in his bed by his flatmate Andrew Hardwick.

Packages from all over the world, including the Netherlands and Poland, were found in his room.

An inquest into his death, held at Hull Coroner's Court, ruled it was an accidental death contributed to by the misuse of drugs.

Ms Wood said: "Monday to Friday, he was a normal lad who worked.

"But at the weekend, it was party time. So he thought 'Let's have something to give us a buzz'. I knew he probably dabbled in something but I didn't know to what extent ? if I ever asked him, he would laugh it off.

"I didn't think for a minute he was into anything that strong. But I don't think me knowing would have made a difference ? he was 28 and a man, so he wouldn't have listened."

Ms Wood, of South Cave, says some parents may mistake signs of drug taking for a hangover from alcohol.

She said: "When they come home drunk, is it that they are drunk or have they taken something?

"It all fits into place when you know the facts.

"After the funeral, someone said to me they didn't realise Richard was a drug addict, but he wasn't.

"You wouldn't call someone who gets drunk on a Saturday night an alcoholic.

"He just used drugs as a way to relax at the end of the week."

Mr Oates, who worked as a landscape gardener, was found at his home in Market Weighton in July.

A post mortem revealed he had morphine in his blood, possibly from elicit opium use.

The morphine caused him to have a depressed respiratory system, which made his breathing more shallow, causing pneumonia.

The medical cause of death was found to be bilateral pneumonia due to the effects of morphine.

Giving evidence at court, Richard's father Keith said: "He was a party animal, who lived for the weekends.

"He was laidback and never got stressed.

"He was a quiet person at first but the life and soul of the party when you got to know him."

Mr Oates had been living in Market Weighton since December.

He last spoke to his father on the phone on July 17.

On July 19, Mr Hardwick returned home to find Richard dead.

Mr Hardwick said: "He was naked and his lower half was partially covered by the duvet.

"I grabbed one of his legs and shook it but he wasn't moving.

"I could see his stomach wasn't moving so I called 999.

"It was quite a shock to see him like that."

Assistant deputy coroner Rosemary Baxter recorded a verdict of accidental death contributed to by the misuse of drugs.

Speaking after the inquest, Ms Wood said: "Richard was using internet forums to get the drugs.

"He was only spending about ?3 or ?4 at a time, so they are very cheap to buy.

"The police seized his laptop and phone but they said they didn't have the resources to look into how he ordered them ? how you can order them and they just arrive at the door beggars belief.

"I don't want Richard to be just another statistic ? people need to know."

Thus, anyone in possession of damaging information has the leverage to blackmail or influence the leader?s?decisions.

I have heard quite a few people say that what the Director of the CIA does in his private life is no one?s business.?Petraeus?s covert affair with a married woman subjected him to the possibility of blackmail and coercion by anyone (including the woman he was having an?affair?with) ?with the power to reveal his secret. As demonstrated by his immediate resignation, this information had the power to destroy or damage his agency, career, marriage and other important relationships.

It is a well established and wise principle in the intelligence and law enforcement professions that one must conduct his or her private life in a manner that no person with could find information which provides leverage to blackmail, coerce or influence the professional?s behavior. (In fact, blackmail of this sort is one way the CIA gets people to betray their country).

Even low level CIA employees who need to keep their private behavior secret become a security risk as they are vulnerable to anyone who threatens to reveal the secret.

This is one of the ?most egregious cases of unprofessional conduct one could imagine and ultimately, Patraeus knew it. If he didn?t resign he would have to be fired.

On the personal level, what he subjected his wife and others who have a stake in his reputation to is also irresponsible as well as unethical (immoral).

By the way, the woman who betrayed her spouse and humiliated her kids as well seems to be getting a free ride.

Condom conundrum: Porn industry ponders latex law

LOS ANGELES (AP) ? The show must go on, is the entertainer's credo, and it did just that in the nation's Porn Capital even after Los Angeles County voted to require performers to use condoms when filming sex scenes.

One of the industry's biggest stars, James Deen, reported for work, condom-free as usual, just hours after voters adopted the new law.

During a break in the action Thursday, however, Deen raised the same questions on the mind of everyone in LA's billion-dollar-plus porn industry: Can a planned court challenge get the new law tossed out before it is even implemented? Or, perhaps this time next year, will he be making films like "Atomic Vixens" and "Asian Fever Sex Objects" in some place like Las Vegas or Florida?

The law, listed on the ballot as Measure B, was passed by 56 percent of voters Tuesday. It won't take effect until election results are certified, which likely will be several more days. It could take months longer before county health officials decide how to enforce it and whether they must begin dispatching prophylactic police officers to keep a close eye on actors.

The Department of Public Health issued a terse statement with no timetable for developing an enforcement plan. There was no hint of whether there would be surprise inspections or if public employees would be paid to watch porn flicks to see if actors were complying.

The nation's adult entertainment industry, which is believed to generate as much as $7 billion a year in revenue, according to the trade publication Adult Video News, vigorously opposed the new law. It argued it is unneeded because of safeguards that include monthly venereal disease checks for all working actors.

They also maintained it would be costly and difficult to enforce and could drive the business out of Los Angeles' sprawling San Fernando Valley, taking with it as many as 10,000 jobs, including actors, directors, film editors and crafts and makeup people.

The main problem, they say, is that fans don't want to see actors using condoms.

"The last time we attempted to go all condom, our industry lost sales by over 30 percent," said Deen. "That's a huge hit to our economy."

Deen, who has appeared in more than 1,000 hardcore films over the past nine years and estimates he's been in about 4,000 sex scenes, said he's never been infected with any disease and he gets tested every two weeks.

"I love condoms, I think they're great and the safest thing you can do in engaging in sexual intercourse with a stranger," he said, adding he uses them in his personal life but not onscreen.

Industry officials, meanwhile, say the last reported case of HIV linked directly to work was in 2004. Since then, they add, about 300,000 films have been made.

Michael Weinstein, the nonprofit AIDS Healthcare Foundation's founder and president, disputes those figures, saying there have been other, more recent HIV infections, not to mention numerous cases of gonorrhea, chlamydia and other sexually transmitted diseases.

Weinstein, whose group led a petition campaign to place the measure on the ballot, says he plans to take his campaign statewide.

In the meantime, he says implementing and enforcing the new law should be easy.

"This is no different than supervising restaurants or nail salons or barbershops," Weinstein said. "You fill out forms, you are granted a permit and, periodically, somebody goes out and does spot inspections."

Easy to implement or not, porn producers say the cost of paying for permits will likely be steep and the drop-off in sales could bankrupt them.

"Certainly this is the biggest threat that I've seen to the industry in a very, very long time," said Steven Hirsch, chief executive of Vivid Entertainment Group, one of the largest purveyors of porn films, including celebrity sex tapes and popular X-rated parodies of "Batman" and "Superman" films. "There have been obscenity prosecutions, but this is something on a whole different level."

Hirsch, who co-founded Vivid 28 years ago, said he is confident the industry will get the law overturned on the grounds it violates filmmakers' First Amendment rights of free expression.

If it isn't overturned, he said his company will simply move production out of Los Angeles County to survive.

Several people who attended an emergency meeting of the industry's advocacy group, the Free Speech Coalition, last week, said porn producers have already been in touch with officials in Las Vegas and parts of Florida. In some instances, they said, tax incentives have been offered to lure them.

Through a quirk in county law, the industry might even be able to pack up and move just a few miles down the freeway to Pasadena or Long Beach.

Those municipalities, although located in Los Angeles County, have their own health departments, and Pasadena said earlier this week it won't enforce the new law.

That would be just fine for many actors and directors, who say they don't really want to leave their home base.

"People forget that porn people are people too," said Kylie Ireland, a veteran actress and director who has appeared in such films as "Being Porn Again" and "Calipornication."

"They forget that we have families and we are married and we have kids and we have lives and jobs and hobbies just like everybody else."

Kremlin chief says he knew about corruption probe

MOSCOW (AP) ? President Vladimir Putin's chief of staff has acknowledged he was aware of alleged embezzlement of state funds earmarked for Russia's satellite navigation system, a statement seen by some as a sign of an intensifying battle among the Kremlin clans.

Sergei Ivanov said he discussed the probe with police officials but didn't speak publicly about it for several years, to prevent the culprits from covering up their deeds. Ivanov, a KGB veteran like Putin, said years in the spy service taught him to be sly with the enemy.

"I have spent a large part of my life in foreign intelligence," he told Channel One television. "The most horrible thing there is betrayal, and here we had the same thing. I had to be patient and not let my feelings show, because I realized that if I did that it would tip them off and push them to cover up their trail."

Ivanov's comments, broadcast late Sunday, come after a Russian police official said Friday that the Interior Ministry was investigating the allegations of embezzlement of 6.5 billion rubles (over $200 million) earmarked for Russia's GLONASS satellite navigation system. As a former Cabinet member, Ivanov previously oversaw the development of the system that competes with the GPS navigation system run by the United States.

The allegations follow a military corruption scandal that led to last week's ouster of Defense Minister Anatoly Serdyukov, and some observers alleged a link between them.

Some commentators saw Ivanov's comments as a clumsy attempt to avoid blame for allowing corruption to flourish at the ambitious project that has seen a series of humiliating failures in recent years, including the loss of three satellites in a failed launch in December 2010.

"It's a specifically Russian way of investigating corruption: after learning that someone intends to steal state funds through shell companies you just hide and wait for two or three years," Anton Nosik, a prominent blogger, wrote in a sardonic post Monday.

Valery Morozov, an anti-corruption activist, said in his blog that the claims of embezzlement appeared to reflect the infighting among the Kremlin clans. Ivanov was widely seen as a driving force behind Serdyukov's ouster, and the other camp seemed to strike back with the claim of corruption in GLONASS, Morozov said.

While Putin linked Serdyukov's departure to a probe into military corruption, most experts believe he was sacked because of an intensifying behind-the-scenes battle for the distribution of 20 trillion rubles ($635 billion) that the Kremlin plans to spend on buying new weapons through 2020. Serdyukov was refusing to sign new weapons contracts, demanding higher quality and cheaper prices from the military industry, a stance that angered industry leaders with strong Kremlin connections.

Vladimir Milov, a former deputy energy minister turned opposition leader, said in a commentary posted Monday on online Gazeta.ru that Putin seems unable to mediate the escalating conflicts between his lieutenants.

"Putin has failed to maintain a reasonable balance of forces in his entourage after his return to the presidency," Milov wrote. "Simply speaking, Putin has rarely shown up at work and has been reluctant to play the role of an efficient arbiter on domestic conflicts that he did so well at the peak of his popularity."

The action-man image Putin has cultivated throughout his 13-year tenure has faded recently, as Putin has canceled several foreign trips in the past few weeks and spent most of his time at his suburban residence, fueling media speculation about a back problem. One recent newspaper report claimed that he had injured himself in a widely publicized flight with Siberian cranes in a motorized hang-glider in September.

His spokesman has said that Putin is suffering from a pulled muscle, but insisted that it resulted from judo training and had no connection to the flight.

UK Lawmakers Will Question Google, Starbucks ... - Business Insider

LONDON (Reuters) - UK lawmakers will quiz executives of Starbucks, Google and Amazon on Monday about how they have managed to pay only small amounts of tax in Britain while racking up billions of dollars worth of sales here.

The Public Accounts Committee (PAC), which is charged with monitoring government financial affairs, has invited the companies to give evidence amid mounting public and political concern about tax avoidance by big international companies.

"It is hard for the ordinary person to believe it's fair," said Margaret Hodge, a member of parliament for the opposition Labour party and chairman of PAC.

"It makes people incredibly angry in the current fiscal climate," she added, in reference to the austerity measures which large budget deficits have forced on the UK, and other countries.

Britain and Germany last week announced plans to push the Group of 20 economic powers to make multinational companies pay their "fair share" of taxes following reports of large firms exploiting loopholes to avoid taxes.

A Reuters report last month showed that Starbucks had paid no corporation, or income, tax in the UK in the past three years.

The world's biggest coffee chain paid only 8.6 million pounds ($13.74 million) in total UK tax over 13 years during which it recorded sales of 3.1 billion pounds.

Campaign group UK Uncut, which is opposed to government austerity measures, and which has organised protests against British telecoms operator Vodafoneand pharmacist Boots over their tax practices, said in a statement on Monday that they planned to target Starbucks.

Starbucks said it followed the tax rules in every country where it operates and sought to pay its fair share of taxes.

"We are committed to being transparent on this issue and look forward to appearing before this committee," a spokeswoman said.

Starbucks Chief Financial Officer Tory Alstead will give evidence to the committee, as will Matt Brittin, Chief Executive Officer of Google UK, and Andrew Cecil, Brussels-based Director of Public Policy for Amazon, a PAC spokesman said.

Google's filings show it had $4 billion of sales in the UK last year, but despite having a group-wide profit margin of 33 percent, its main UK unit had a tax charge of just 3.4 million pounds in 2011.

The company avoids UK tax by channeling non-U.S. sales via an Irish unit, an arrangement that allowed it to pay taxes at a rate of 3.2 percent on non-U.S. profits. Amazon's main UK unit paid less than 1 million pounds in income tax last year. The company had UK sales worth $5.3-7.2 billion, filings show.

Amazon avoids UK taxes by reporting European sales through a Luxembourg-based unit. This structure allowed it to pay a tax rate of 11 percent on foreign profits last year - less than half the average corporate income tax rate in its major markets.

Google declined to comment. Amazon did not respond to requests for comment.

Hodge and former financial services minister Paul Myners told the Sunday Telegraph newspaper that the government should consider a new revenue-based tax to ensure profits from UK sales didn't go offshore.

And now that Mr. Obama has been re-elected, ?I?m elated,? said Dr. Chalfie, a professor of biological sciences at Columbia who shared the Nobel Prize in Chemistry in 2008. ?I was particularly happy that in his victory speech, he again emphasized the importance of science and education.?

But the particulars of Mr. Obama?s science goals for his second term are not known. Neither he nor his opponent, Mitt Romney, spoke much about the topic during the campaign, but given Mr. Romney?s promise of cutting taxes, the presumption was that he would have proposed deep cuts in science spending.

?All the indications are that the discretionary budget would have been a prime cut of beef on the chopping block,? said Michael S. Lubell, a physics professor at City College and director of public affairs at the American Physical Society.

Indeed, not much may change in science policy in Mr. Obama?s second term, and for many scientists like Dr. Chalfie, that is a good thing.

The expectation is that Mr. Obama will continue pushing for many of the same priorities as he did during his first term, like robust financing of basic research, especially in energy. ?I would expect those priorities to continue,? said Matthew Hourihan, director of the research and development budget and policy program at the American Association for the Advancement of Science.

Mr. Hourihan said Mr. Obama?s support for science and technology research ?has been fairly strong,? although he was not able to fulfill campaign promises from 2008 to double research financing at many agencies.

As with other issues in Washington, it is not clear whether Mr. Obama will be able to act on more of his priorities. The balance of power and cast of characters have not changed: Democrats control the Senate, the Republicans still hold the House.

?For the most part, we?re looking at the same power dynamics,? Mr. Hourihan said.

The greatest worry is that the so-called ?fiscal cliff? will be reached at the end of the year, with the tax cuts passed under President George W. Bush expiring and automatic, across-the-board budget cuts taking effect. Federal agencies like the National Institutes of Health, NASA and the National Science Foundation would all see their budgets drop by about 8 percent.

That would be catastrophic for researchers, Dr. Lubell said. The science foundation issues three-year research grants, so an 8 percent budget cut could translate to a drop in new grants by one-fourth. Facilities at national laboratories used by scientists would also likely be cut sharply.

On the plus side, without having to worry about re-election, Mr. Obama could perhaps undertake new initiatives.

David Baltimore, a biology professor and former president of the California Institute of Technology ? and another Nobel laureate who signed the Obama endorsement ? said he hoped that the president in his second term would ?have the political space to take on climate change.?

Dr. Lubell agreed. ?If Romney had been elected, there is no question climate change would have been put on the back burner,? he said. ?Obama will, I think, begin to address some of these things.?

NASA officials have also been pushing for a small space station that would hover over the far side of the Moon, the first human mission to venture beyond low-Earth orbit since the last of the moon landings four decades ago. It is not known what White House officials think of that idea.

With a pair of 9-0 wins over Denison and Georgetown at the Navy Squash Veterans Weekend Round Robin on Sunday, the Midshipmen pushed their unbeaten streak to 13 after the first two weeks of the season. Navy began the weekend with a 7-0 record, adding a pair of wins in each of the last three days.
