?I?ve come to the conclusion that there are some really impossible jobs out there. For example, being Nick Clegg?s blue tie manufacturer or, even worse, an entrenched Arabic copywriter at any creative agency. Personally, and with all due respect to yoga teachers everywhere, I believe the latter to be the most frustrating and troublesome. The Arabic language is an an incredibly rich one; it?s diverse, full of subtleties and wholly subject to sweeping changes within the geography of the region.

But surely the same could be said for English? And yet we don?t have the constant claims from most clients that the English isn?t up to scratch? I believe it?s because we?ve grasped that English has diversity and we channel briefs to the correct resources. However, I believe we still treat Arabic writers differently. We expect them to communicate to all readers/listeners using one treatment a bit like speaking in tongues. Would you necessarily believe that the marble-rolled Old Etonian vocabulary would be grasped in full by Buck on the Detroit production line? I very much doubt it. So we realise proper localisation and cultural insightfulness often only offered by a native speaker is required. Not so for Arabic, it?s more a case of one-size-should-fits-all.

So perhaps the choice of a non-Saudi copywriter to sell to Riyadh-based Saudis would be ill advised. The demand for great Arabic copy in all markets is probably only equalled by the scale of its non-delivery. We must attempt to use culturally and geographically aware writers to sell the brands we represent whenever possible as anything else is dilution. Remember, copy isn?t art direction. Although a picture can be worth
a thousand words, if you are using those thousand words, they?d better be in a style and a language that the target audience will understand and relate to.? There?s an old saying that if you put four Arabic writers in a room you?ll end up with five opinions, and there?s nothing wrong with that. It?s a good thing. Listen to them.?

Welcome to 21 Days of Detoxing with clean, whole, real food! Yep, we?re at it again with another awesomely motivated group. Elegant.

That?s what I had in mind as I created this real food dessert for my detoxers. Something simple and all grown up, like pearl earrings.

Here?s what really happened.

I made a huge mess pouring the warm mixture into glasses. I finally got it, stuck one glass in the fridge and drank the other one warm because I was dying to try it (tasty, but less-than-sophisticated approach.) Oh well.

The next day I took the glass out and my toddler, thinking it was a glass of milk, wrestled me for it. He finally got it and held the glass up to his lips. Tipped his head back. Waited for that moment where he?d drink milk like a big boy (ie no sippy cup).

He was very confused why the milk was stuck in the glass. But when I grabbed a spoon and showed him how to spoon it out, he caught on right away. And devoured it.

So there you have it. About as elegant as it gets in my house. For the rest of you ? try this with sparkling mint water or ginger tea, or post detox maybe a glass of Riesling.

Vanilla Pear Panna Cotta
1 can coconut milk
1/2 tsp. vanilla extract
1 Tbl. pure maple syrup
2 tsp. agar agar flakes (find in the asian aisle at natural food stores, near the nori)
1/2 pear, grated

In a small pot, combine coconut milk, vanilla and maple syrup. Bring to a boil, then add agar agar flakes and simmer for 5 minutes, whisking continuously to dissolve the flakes.

Remove from heat. Grate pear into the coconut mixture. Allow to cool a bit, then pour into serving glasses and refrigerate at least 2 hours to set.

In 2010 Egypt discussed taking military action in cooperation with Sudan against Ethiopia to protect their stake in Nile River, according to internal emails from the U.S. private-security firm Stratfor.

Egypt and Sudan get 90 percent of the river?s water under colonial-era accords while upstream countries including Uganda, Rwanda, Tanzania, Kenya and Ethiopia have been clamoring for a new deal during more than a decade of talks.

The Nile flows south to north,?making it one of only a handful of rivers in the world to do so and one of only two in Africa.

So, rather than Cairo sitting at the mouth of the massive water supply, it sits dead last?subject to all the whims and fancies of each upstream nation. With several factional governments upstream and the premium on fresh water, diplomacy only goes so far.

A dispatch from May 26, 2010, that cited information from a?Egyptian diplomatic source points to the country's frustration:

Sudanese president Umar al-Bashir has agreed to allow the Egyptians to?build an a small airbase in Kusti to accommodate Egyptian commandos who?might be sent to Ethiopia to destroy water facilities on the Blue Nile...?It?will be their option if everything else fails

The Blue Nile, which begins in Ethiopia,?contributes about 85 percent of the flow that passes through Egypt to the Mediterranean.

Ethiopia is also currently struggling to fund the dam, which would need foreign aid to be completed.?Egypt and Sudan have lobbied foreign donors to refrain from funding the project while they try to find a diplomatic solution to the increasingly dire water situation.

A dispatch from June 1, 2010, that cited a "high-level Egyptian security/intel source, in regular?direct contact with Mubarak and [then-intelligence head Omar] Suleiman" said:

The only country that is not cooperating is Ethiopia. We are continuing?to talk to them, using the diplomatic approach. Yes, we are discussing?military cooperation with Sudan. ...?If it comes to a crisis, we will send a jet to bomb the dam?and come back in one day, simple as that. Or we can send our special?forces in to block/sabotage the dam...?Look back to an operation?Egypt did in the mid-late 1970s, i think 1976, when Ethiopia was trying to?build a large dam. A dispatch from July 29, 2010, that cited the Egyptian ambassador to Lebanon said that Egypt and leaders of the soon-to-be independent?southern region of Sudan "agreed on developing strategic relations?between their two countries," including Egypt training the South Sudan military, and noted that "the?horizons for Egyptian-southern Sudanese cooperation are limitless since?the south needs everything."

In 1979 Anwar Sadat, Egypt?s second president,?said: ?The only matter that could take Egypt to war again is water."

The government of current Egyptian President?Mohammed Morsi described the Stratfor emails as?hearsay ?designed to disturb Egyptian-Ethiopian relations.?

When you and boss split, social media can be an issue

If you and your company get an ugly divorce, does your company get to keep the friends?

A controversial court ruling last week has shined a light on this made-in-the-digital age problem: Who owns Twitter followers, Facebook friends and LinkedIn connections when employers and employees part ways? With personal and professional lives mingled online as never before, a distinctly 21st Century fight is brewing over who owns your friendships.

A ?federal judge in Pennsylvania on Oct. 4 rejected a claim by Linda Eagle that her prior employee had illegally accessed her LinkedIn account after she left her company, Edcomm. Workers there changed Eagle's password after her departure, preventing her from accessing critical contacts and, she claimed, damaged her ability to find new work.?

But the judge dismissed most elements of her lawsuit, giving fuel to those who argue that social media groomed at work belongs to employers.

"The initial outcome of the case is very troubling," said Bradley Shear, a Washington, D.C.,-area lawyer who specializes in social media. It opens the door for employers to claim ownership of any social account -- even personal accounts -- because Eagle's account was created under her own name, he warned. "It demonstrates there's a need for people to become much more educated about this."


Other court rulings have hinted that courts might be inclined to see things the employer's way.? Earlier this year, a federal California court allowed a publication named PhoneDog to proceed with a lawsuit against former writer Noah Kravitz, who had amassed 17,000 Twitter followers while working there.

Kravitz claimed the followers were his, but PhoneDog sued for ownership in 2011, and the judge denied a motion to dismiss the case in a February ruling ? a positive sign for PhoneDog?s legal argument. Two other recent cases also sided with firms making ownership claims on social media contacts.

Eric Goldman, a law professor at Santa Clara University, cautioned that each of these cases is "incredibly fact specific," and none establishes a universal principle that could be widely applied. Still, workers should be on notice that their employer getting their ?friends in the divorce is not so far-fetched.

"People should learn from this that it's dangerous to mix business with pleasure," he said.

In many ways, the "who owns the connections and the conversations" issue is unique to social media and the digital age.? In the past, there was never any question that a public relations professional was speaking on behalf of a company, and that communication was company-owned ?? ?as were the contact lists. But what of a long-time flack who arrives at a new firm with a long list of her own Twitter followers, and who writes messages using that account that are decidedly personal?? Who owns those messages, and those contacts? The issue is as murky as most employees' work-life balance.

?Many of these accounts have 'mingled interests,' " Goldman said. ?That makes things difficult.?

In fact, the very nature of social media means the accounts don't really work unless they have a touch of personality. Tweeted press releases aren't interesting on Twitter; personal wit is regarded above all, and encouraged at every smart firm with a social media presence.?

On the other hand, it's reasonable to think of LinkedIn contacts as akin to customer lists, which are clearly proprietary and belong to employers as intellectual property. For decades, firms have claimed ownership of client lists (and employees have tried sneak out the door with them). If a LinkedIn account is little more than a list of business connections that are directly related to a job, why wouldn't a company claim it?

Of course, fights over Rolodexes aren?t new ? but old-fashioned piles of business cards make a poor analogy for a long-curated group of Twitter followers. ?Besides, users who have a developed a personal relationship with a social media creator aren't likely to be much use to a company which takes over an account, Goldman noted.

?You can grab the Rolodex, but you can?t really grab the relationship?? he said.

There's also the subtle "you are nothing without me" argument. When television anchor and early Twitter adopter Rick Sanchez left CNN, he had a follower list of 150,000. Without CNN, Sanchez would not have compiled such a following, and when he left, observers imagined a brewing controversy. A fight was averted when CNN Sanchez keep the list as long as he changed his Twitter handle, from @ricksanchezcnn to @ricksancheznews .

LinkedIn hasn't offered a lot of guidance in the issue, but in a brief statement to NBC News, the company seemed to suggest that it might take up the fight on behalf of users at some point.

"We don't know the specific facts and circumstances of the relationships or agreements between Ms. Eagle and her former employer, nor are we parties to the lawsuit, so we can't comment on it specifically," said LinkedIn spokesman Hani Durzy. "However, LinkedIn prides itself on being a members-first organization, and in general we believe that a member's professional profile belongs to them.?

Other digital-era issues offer conflicting notions.? In the United States, employees have no right to privacy over emails they write at work, even if they are using personal email accounts. Employers are within their rights to employ snooping software to watch everything workers do with company computers.? That might suggest any Facebook or Twitter work done by an employee on company property belongs to the company. On the other hand, there's a long history of domain name confusion that sides with workers. Employees who register company domains in their own names, for example, often end up with an awful lot of leverage after they leave the company -- they can redirect the domain, for example.

To Shear, the lawyer specializing in social media, that leads to a practical question for companies that might be inclined to make claims on social media accounts.

"LinkedIn is an external system. Why are you are putting resources into an external system that you don't have control over?? Companies prefer their own email to Gmail for this reason," he said.?

One critical element of the Eagle case is that she had shared her password with a coworker, who updated the LinkedIn page for her. That put the company in a good position to make a claim -- it could change the password, lock her out and ask questions later.? So should employees refuse such password sharing? Some companies compel users to do so, though increasingly state legislatures are considering laws making the practice illegal. ?Meanwhile, most social networks -- including LinkedIn -- say it's against their terms of service to share passwords.

There may already be existing laws that cover a lot of this controversy. Non-compete and non-solicitation agreements -- which prevent workers from contacting clients after exiting a firm -- prevent a lot of the issues that businesses are really concerned about when they make social media contact claims.? Still, those are often unenforceable, particularly in California, which has broad employment right laws. That has Shear and Goldman concerned that future employment agreements will contain the broadest possible provisions, with companies seeking rights to all online relationships while workers are in their employ.

"That would be an egregious overreach," Goldman warned.

It would also kill the spirit of social media, as popular Twitter posters would disappear overnight, each time they change jobs.

"In the end, we as readers will be the losers, because we won't be able to find the people we are looking for," he said

There is one saving grace in this discussion: Despite our pride of amassing a few thousand friends or followers, Goldman points out that most social media accounts are not so valuable that they are worth fighting over in court.

"The economics don't support litigation," he said. "How much is an account with 17,000 followers worth?? At $1 a follower, that's $17,000 -- that would hardly even get (the lawsuit) filed."

RED TAPE WRESTLING TIPS
Both Shear and Goldman stressed that companies need to have very specific social media policies -- pre-nuptial agreements, if you will -- specifying who gets what when the inevitable breakup arrives.?

For workers who are concerned, Shear offers three quick tips.

  • Make sure the email used to set up the social networking account is a personal email that you control, not a corporate email address that can be cut off -- and could be used as evidence of ownership in litigation. Also, use personal contact information, such as a home number and address.
  • Make sure the name on the account is personal -- Sally Smith, not Sally_XYZCompany. Finally, use a personal photograph, rather than a company logo, in the profile picture.

The Deadly Disgrace of Obama's Pro-Terrorist Lawyers

October 12 marks the 12th anniversary of the bombing of the USS Cole. The grim milestone comes as President Obama faces mounting questions about his administration's dereliction of duty during the murderous attack on our consulate in Benghazi, Libya. And it comes just a day after resurgent al-Qaida thugs pulled off the drive-by assassination of a top Yemeni security official who worked at the U.S. embassy in Sanaa.

These are not "bumps in the road." These are gravesites on the blood-spattered path to surrender.

Seventeen U.S. sailors died in the brutal suicide attack on the guided Navy missile destroyer as it refueled at the Yemeni port of Aden in the fall of 2000. Then-President Bill Clinton vowed to track down the Muslim terrorist attackers: "We will find out who was responsible and hold them accountable." But a dozen disgraceful years later, Slick Willy's toothless promise has become a bitter punch line.

The current Democratic White House has not only delayed and denied justice to the victims and their families. President Obama's foot-dragging administration, crawling with pro-terrorist lawyers, effectively undermines our nation's ability to detain, contain and destroy jihad threats from within and without.

Suspected Cole bombing suspect and former Persian Gulf Operations Chief for al-Qaida Abd al-Rahim al-Nashiri has been in U.S. custody since 2002 and at Gitmo since 2006. In February 2009, Obama met with Cole families and promised them justice. Then, he stabbed them in the back by ordering the (Social) Justice Department to abandon the death penalty case assembled against the al-Qaida mastermind under the Bush administration.

That's right: The Osama bin Laden football-spikers in the Obama administration deliberately dropped the USS Cole ball on al-Nashiri's military prosecution because of their opposition to the Guantanamo Bay detention system. Jesse Nieto, father of murdered Cole sailor Marc Nieto, won't forget it. "That really left a bitter, bad taste in my mouth," he told the Newnan (Ga.) Times-Herald earlier this year.

In 2011, the Obama administration reinstated the charges amid a widespread backlash against Attorney General Eric Holder's plans to bestow U.S. civilian trials in Manhattan to foreign Gitmo goons. But the trial has been plagued by yet more delays and left-wing lawyer antics painting Nashiri as a victim of American hegemony. "This whole trial is a political football the politicians are playing with," Nieto aptly noted. "If they left it to the military, it would be taken care of. And it would be fair."

Team Obama's initial withdrawal from the prosecution came out of left field ? literally. But it is no surprise to those who paid attention to Holder's radical ideological and corporate allegiances.

As I reported in "Culture of Corruption," Holder joined the prestigious Covington and Burling business and corporate law firm after a quarter-century as a government lawyer. The stint boosted his net worth to nearly $6 million. Covington and Burling's post-9/11 claim to fame? Representing 17 terror suspects held at Gitmo who hail from Yemen, long a safe haven for terrorists. (Another Cole bombing mastermind, Jamal Mohammed al Badawi, was convicted and sentenced to die in Yemen for the terror attack, but somehow escaped twice from jail and was freed by the Yemeni government in 2007.)

Holder's law firm employed dozens of radical attorneys such as David Remes and Marc Falkoff to provide the enemy combatants with more than 3,000 hours of pro bono representation. Covington and Burling secured victories for several Gitmo enemy combatants in the U.S. Court of Appeals for the D.C. Circuit. Remes, who garnered human rights awards for Covington and Burling before striking out on his own, now represents Nashiri.

Falkoff went on to publish a book of poetry, "Poems from Guantanamo: The Detainees Speak," which he dedicated to the suspected terrorists: "For my friends inside the wire, Mahmoad, Majid, Yasein, Saeed, Abdulsalam, Mohammed, Adnan, Jamal, Othman, Adil, Mohamed, Abdulmalik, Areef, Adeq, Farouk, Salman, and Makhtar. Inshallah, we will next meet over coffee in your homes in Yemen."

One of the class of Yemeni Gitmo detainees that Falkoff described as "gentle, thoughtful young men" was released in 2005 ? only to blow himself up (gently and thoughtfully, of course) in a truck bombing in Mosul, Iraq, in 2008, killing 13 soldiers from the 2nd Iraqi Army division and seriously wounding 42 others.

In January 2010, The Times of London reported that "at least a dozen former Guantanamo Bay inmates (had) rejoined al-Qaida to fight in Yemen." Another Yemeni Gitmo recidivist and top al-Qaida leader, Said al-Shihri, was freed after undergoing "rehabilitation" ? and then promptly rejoined jihadi forces. He was reportedly killed in a U.S. missile strike last month.

In February 2010, GOP Sen. Charles Grassley forced Holder to acknowledge that at least nine DOJ attorneys officially represented or served as advocates for Gitmo detainees before joining the Obama administration. They work in the offices of the attorney general, the acting deputy attorney general, the associate attorney general, and the assistant attorney general for the criminal division. In addition, the assistant attorney general for the civil division previously represented one Afghan detainee, and his former employer represents other detainees.

Gitmo recidivists ? a burgeoning Obama demographic that includes suspected Benghazi jihad plotter Abu Sufian Ibrahim Ahmed Hamuda bin Qumu ? certainly are better off than they were four years ago. The question is: Can Americans at home and abroad really afford another four years of Obama, Holder and their soft-on-terror government attorneys sabotaging national security?

Chicago schools chief out after run-ins with Mayor Rahm Emanuel

Nearly four weeks since the end of the first teachers strike in 25 years, and 17 months after being recruited from Rochester, N.Y., by Chicago Mayor Rahm Emanuel in May 2011, Chicago Public Schools CEO Jean-Claude Brizard is stepping down.

Mr. Brizard?s resignation, announced in a statement released early Friday, highlights the difficulties school administrators face in the Chicago system, where school officials are more directly answerable to City Hall and vulnerable to the political pressures on the mayor.

Unlike previous administrators of what is the nation?s third largest public school system, Brizard was touted as an educator first and a business administrator second. His battle scars earned by dealing with a teachers union in his previous job showed Mayor Emanuel that Brizard had similar mettle for dealing with contentious labor issues in Chicago.

Brizard also believed in many of the reforms Emanuel wanted to implement, such as pushing forward more charter schools, closing underperforming schools, and establishing pay grades based on teacher performance and not seniority.

But Brizard was largely absent from view during last month?s strike, a combative standoff that left Emanuel vulnerable to criticism by voices on both the political right and left. Brizard reportedly infuriated Emanuel by taking a vacation in the days leading up to the strike, and his absence from the public eye during negotiations raised questions among Chicago Public Schools (CPS) employees whether he had resigned. That led Brizard to send an e-mail to staff denying the rumor.

In an interview with the Chicago Tribune Friday, Brizard suggested that his management style did not fit well with City Hall. ?I call it a marriage that was perhaps imperfect. My style and personality is maybe not what the mayor wants. I have felt he is not comfortable with me,? he said.

Media accounts suggest Emanuel was critical of Brizard?s management decisions involving key hires within the system, and as mounting news stories made that displeasure public, it became clear Brizard was a liability.

?The questions about J.C. became a distraction from what we had to do. We had a mutual agreement [that the distraction was] not helpful.? It kept on becoming about the static and noise about J.C. He said, ?Look, getting the schools right is more important than me,? ? the mayor told the Chicago Sun-Times Friday.

Steve Tozer, an education professor at the University of Illinois at Chicago and director of the university?s program in urban education leadership, says the political machinations of having the school system controlled by City Hall has its strengths, but tends to make it difficult for school administrators in top leadership roles.

?The consequence of that [structure] is the extent, to which such an individual can lead,? Professor Tozer says, adding that a schools chief ?is more constrained by the mayor?s agenda than ? by a school board agenda. With a school board, there is a shared shaping of that agenda?. The political stakes are so much higher with a mayor who must inevitably seek reelection.?

Brizard is the fifth CEO of CPS since the system went under City Hall control in 1995. Besides former interim CEO Terry Mazany, who served in the administrative transition between former Mayor Richard M. Daley and Emanuel, Brizard?s term was the shortest. The longest CEO to serve was Arne Duncan, who is now secretary of Education under President Obama.

Tozer says Brizard?s ouster likely has less to do with his ability to lead than it has with the politics of the school system that existed before his arrival in Chicago. Emanuel recognized that CPS ?clearly has to do better and has no time to waste in getting better,? which likely drove the mayor to act fast, Tozer says.

Replacing Brizard is Barbara Byrd-Bennett, a former teacher in New York City and CEO of Cleveland?s public school system. Her position as chief education officer for CPS, a position that oversees curriculum development and instructional policy, started this year. She played a more public role in the strike negotiations and was instrumental in drafting the updated teacher evaluation system Emanuel pushed for and won during settlement talks.

?Barbara is a proven leader and educator with the breadth and depth of experience that make her uniquely qualified to serve Chicago?s students and lead Chicago?s schools, and I am incredibly proud to welcome her into this position,? Emanuel said in a statement.

Under the new contract, which the union ratified Tuesday, principals will continue as decision makers in hiring, but layoffs, for the first time in CPS history, will be determined by the level of teacher performance in the classroom, starting with those with the lowest evaluation ratings. Also for the first time, CPS will establish hiring practices that fast-track highly rated teachers who are laid off ? because of school consolidations or closings ? for open positions at other schools in the system.
